Terms and Conditions
These Terms and Conditions govern the contracting of services and/or online and physical purchases of Nutriuny (hereinafter "the Brand") and Marianna Crespo (hereinafter "the Owner") and the website: www.nutriuny.com (hereinafter "the Website"). By continuing to use the Website, as well as in the contracting and/or purchase of services and/or products both online and physically, you accept these Terms and Conditions. Acceptance of these terms is implied after users have had the opportunity to read and understand them. Clients and/or users who wish to obtain the services and/or products, access them physically or through the Website will be subject to these Terms and Conditions, internal policies, and principles of the service and its owner, which are indicated in this document.
In the event of not being in agreement with this document, clients and/or users may not use the Website, nor obtain services and/or products online and/or physically; and must refrain from doing so.
GENERAL INFORMATION AND PURPOSE
This document establishes the Terms and Conditions of the services and/or online and physical purchases of the Brand, the Owner, and the Website, constituting a contract that is voluntarily entered into between the client and/or user and the Owner for obtaining the services and/or online and physical purchases on its different platforms and social networks. The services offered virtually, as well as through the Website, consist of: nutritional consultations, nutrition programs, nutrition education offered through challenges and workshops, as well as the provision of online manuals and pre-recorded videos of classes to provide information regarding nutrition and well-being. Obtaining the aforementioned services will be virtually at the link indicated and/or through registration and payment for them on the Website.
TERMS AND CONDITIONS
By accessing the Website and obtaining services and/or products, clients and/or users declare that they understand and are in full knowledge of and agree to or accept the following:
ONLINE SERVICE
Online Access and Registration: To obtain access, services, and use the web platform, it is essential that the interested party is not under 18 years of age and that they fully complete the fields required in the registration form, indicating the necessary personal information. The user's account will be created with the information obtained, which will be personal and non-transferable. The user must accept the Privacy Notice and these Terms and Conditions. The user may access the Website services using the email address provided and the password that they have created. The user will be identified with their email and the name that they have indicated in the registration, as well as with the photograph that they attach, according to their choice. The Owner will not guarantee the identity of registered users and is therefore not responsible for the use of the identity of a registered user by a third party.
Password: The password indicated by the user to create the account and/or register for the services will be the sole and exclusive property of the user. The Owner and its staff or technical providers of the Website will not have access to this information at any time. If the indicated password is lost or forgotten, the user may recover it through the Website in the section indicated to reset it. The user is responsible for any activity under their account.
Cancellation of the Service or Subscription: The user may unsubscribe and/or cancel the subscription service in the “My Account” section, where the option to cancel the subscription will be indicated. The user is able to cancel the services paid for within 14 days of their purchase. The user's cancellation will take effect immediately. In the case of a monthly subscription, the cancellation will take effect in the month following the one in which it is made, and the cancellation or cancellation of the renewal of the service will be understood to be for the following month. To cancel the services or subscriptions for the following month or period, the user must cancel at least 72 hours before the start of the following monthly payment date. The user will maintain access to the platform for the remaining time until the end of said month. The services are offered for one-time payments or monthly periods, so it will not be possible to obtain them for a time less than the indicated period. Likewise, the user may cancel the online consultation through Calendly or email; canceling appointments with at least 24 hours in advance allows the client to reschedule without losing their deposit. However, all cancellations made with 12 hours or less notice will lose the opportunity for deposit refund. All clients have the right to a refund within a 14-day period, as long as the service hasn't been provided.
Payment of the Service: Once registration has been completed and the Privacy Notice and these Terms and Conditions have been accepted, payment for the selected service must be made. Only registered users may make the indicated payment, which will be via bank transfer.
Intellectual Property: All content on the Nutriuny website, including but not limited to text, images, graphics, logos, videos, and software, is protected by intellectual property laws and is the exclusive property of Nutriuny or its licensors. You may not use, reproduce, distribute, or modify any of our content without prior written consent from Nutriuny or any production from Marianna Gomez Pedroso Crespo, and Nutriuny’s team.
Intellectual Privacy Policy: Your use of our website is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using our website, you consent to the practices described in our Privacy Policy.
Pricing and Payment: Product prices are listed in the currency displayed on the website. While we strive to ensure accurate pricing, errors may occur. If an item is listed at an incorrect price, we reserve the right to cancel the order or contact you for further instructions. Payment methods are specified during the checkout process. Please refer to our Payment & Checkout Policy for more information.
EU VAT: Nutriuny covers VAT obligations, meaning that we handle and pay the VAT on applicable purchases. All the prices and products on our website include VAT. We comply with EU VAT regulations and collect and store the necessary information to fulfill our VAT obligations based on our shop/company registration in the Netherlands.
LIABILITY POLICY: The Owner strives to provide quality services but does not guarantee specific results. The user acknowledges that clients are responsible for their own health and well-being. The Owner is not liable for any damages arising from the use of its services, including but not limited to physical injuries or health issues.
Modification of Terms:Â We reserve the right to modify, update, or replace these Terms and Conditions at any time. Changes will be effective upon posting on our website and we will notify you in advance. Your continued use of the website after such changes constitutes your acceptance of the modified terms.
GOVERNING LAW
These Terms and Conditions are governed by Dutch law. Any disputes arising from these Terms will be resolved in the competent courts of the Netherlands.
We appreciate your understanding and cooperation in adhering to these Terms and Conditions, as it helps us provide the best possible service to all of our customers.
User Conduct: You agree to engage in acceptable conduct when interacting with the website, including refraining from fraud, harassment, and illegal activities.
 Canceling Policy
To ensure efficient scheduling and availability for all customers, we have implemented the following cancellation policy:

24-hour notice: We ask that you cancel your appointment at least 24 hours in advance. This allows us to accommodate other clients and manage our schedule effectively, and you can reschedule your appointment without losing your deposit.

12 hour notice: If you need to cancel your appointment with less than 12 hours notice, the appointment will result in the loss of your deposit. Additionally, you will need to reschedule your appointment and provide a new deposit. This fee covers a portion of the time reserved for you. We appreciate your understanding and cooperation in adhering to this policy, as it helps us provide the best possible service to all of our customers.
